Step-parent Adoption

Stepparent Adoption

When a biological parent remarries, the family may want the new husband or wife to adopt the child. The other biological parent can consent - but if he or she does not, legal measures must be taken to terminate parental rights, thereby making the child a candidate for adoption.

If your stepchild's biological parent is no longer alive, you can become his or her legal parent through a fairly straightforward legal process.

If your stepchild's biological parent is alive, the biological parent would have to surrender parental rights, including child custody and visitation rights. The biological parent would then be released from his or her responsibility of paying child support.

If the biological parent is unwilling to surrender his or her parental rights, the case would need to be litigated in family and surrogate's Court.

If the child is 14 years or older, he or she needs to consent to the adoption.

These are the cornerstones of New York stepparent adoption law. The law firm you choose when pursuing or contesting a stepparent adoption should know these statutes like the backs of their hands - and we do.

At the skilled adoption law firm of Clifford Greenberg we have extensive experience handling contested stepparent adoptions throughout New York City and New York state. These lawyers have learned how to prove if a child is in a dangerous situation, or that the biological parent is unfit based on a variety of concerns such as physical abuse, sexual abuse, abandonment, neglect, alcohol and drug addictions and mental illness.

The thousands of adoptions of all kinds that we have successfully handled are proof-positive that we can help you. We welcome the opportunity to meet you, listen to your wishes and goals, and offer recommendations that can translate to effective courses of action.

Adult Adoption

Most adoption cases involve children under the age of 18. However, there is no legal limit on the age at which someone can be adopted in New York. There are a number of reasons why an individual or couple may wish to pursue legal adoption of an adult adoptee.

We have seen the laws in New York change to reflect non-traditional relationships in individuals' best interests. Our founding attorney Cliff Greenberg is a passionate advocate committed to helping families navigate through the legal system, even if the adoption seems untraditional.

Every family dynamic is unique. In some cases, adults with physical or mental limitations may benefit from an adoption. If you are looking to adopt an adult in your family, contact our New York City adult adoption attorneys. We offer free initial consultations so is no risk in finding out about the legal options available to your family.

We are experienced at helping clients explore the options available to protect their loved one's best interests.

We have experience helping clients with all types of adult adoptions including the following:

  •  Mental or physical incapacity: When an adult has become mentally or physically incapacitated, his or her caretaker may wish to consider pursuing an adoption. This would reflect a more intimate relationship than the alternative option of legal guardianship.
  • Foster child adoption: When a child has been brought into a family through foster care but has not been formally adopted before his or her 18th birthday, his or her foster parents may wish to formalize the relationship through and adoption.
  • Recognition of a close relationship: Families come in all shapes. It is not uncommon for unrelated adults to form parent-child bonds. In some cases, it is beneficial for people who have formed these bond to go through the formal adoption process.

We have handled more than 5,000 adoption and have seen a wide range of circumstances. We know no two families are the same. No matter what your circumstances are, you can feel confident knowing we will guide you through the legal system in pursuit of your loved one's best interest.

Private Adoption

Many families choose to work with a licensed adoption agency. The agency provides support, counseling and coaching while working to match you with a birth parent.

At the premier New York adoption law firm of  Clifford L. Greenberg the agencies we work with are caring and compassionate, and have committed social workers who are very helpful. If there are any issues as you deal with the agency's social workers, remember that the agency has its own attorney - and we, as your attorneys, will always be there for you.

Agency adoptions are recommended for prospective adoptive parents who want to let go of the reins and let legitimate adoption professionals do most of the work. Each agency has its own rules and requirements for prospective adoptive parents. If you wish to adopt a newborn, it may require a long period of time. But every case is different.

Most agencies practice open adoption, a factor you will need to consider as the process takes place. Openness is a personal decision regarding the degree of contact you may allow the birth parents to have after an adoption, if at all. It is an important path that the agency and our office can help you navigate.

Once a child has been placed with you, our lawyers prepare all documents for submission to the court, thus ensuring a very happy experience during your journey through the legal system.

When you have decided to grow your family through adoption of any kind, come to the law firm that has handled thousands of adoptions statewide and nationally. Come to  the low Offices of C.L.G

My Inspiration

My children, the two pictured above, are my biggest source of inspiration for what I do. Ever since my oldest son was just 3 years old, I have been faced with the task of bringing up these awe-inspiring individuals all by myself. I sacrificed what little free time I had and dedicated it all to them.

Adoption paper with family cutouts

Beyond Sacrifice, Its Love

I wouldn’t really call it a sacrifice, because that implies giving something up that you wouldn’t have done had the situation not forced you to do so. I wanted to see my children grow to surpass me in every way possible: academically, athletically, and emotionally. Every sports game, piano recital, and elementary school publishing party, no matter how small, I would be there, often one of the only parents at a high school basketball game, but shouting words of encouragement nonetheless.

Because that’s what we do for our kids. We seemingly go above and beyond, but not really; it’s simply what we do for the children we love.
